Oil prices and the hurricane

Earlier today I was ready to scream at the television, "Can we please stop talking about oil for just one hot minute?" Now here I am talking about oil. But it's just one question. Why isn't the increased price of oil in the face of Hurricane Katrina counted as price gouging and therefore an offense for which one can be prosecuted?
